Hong Kong SAR National Security Law to Ensure Hong Kong's Stability and Prosperity

China's top legislature has reviewed the draft law on safeguarding national security in Hong Kong Special Administrative Region (SAR) of the People's Republic of China at the three-day meeting of the 19th session of the 13th National People's Congress (NPC) Standing Committee from June 18th till 20th. This is a crucial step in establishing and improving the legal system and enforcement mechanisms for the HKSAR to safeguard national security.

The draft law, composed of six chapters, explicitly points out that the Central Government of China holds fundamental responsibility for national security related affairs in Hong Kong SAR, while the Hong Kong SAR bears constitutional responsibilities of safeguarding national security. The draft stipulates the important rule-of-law principles that Hong Kong SAR should follow when safeguarding national security, the establishment of institutions by the Hong Kong SAR to safeguard national security including a commission for this purpose, four categories of crimes that threaten national security,as well as case jurisdiction, application of laws and procedures. It also stipulates that the Central Government would establish a commissioner's office for national security affairs in the Hong Kong SAR.

Hong Kong has faced increasingly notable risks in maintaining national security since last year following the proposed legislative amendments. This was particularly manifested in the prolonged social turmoil and street violence. Actions and words advocating "Hong Kong independence" became rampant and external forces blatantly meddled in Hong Kong affairs. These actions pose real threats to national security, infringe upon the rights and freedoms of Hong Kong residents, and affect normal relations between Hong Kong and the rest of the world.

The fundamental purpose of the national security legislation for Hong Kong is to safeguard national sovereignty, security and development interests of the country, to achieve lasting security, stability and prosperity in Hong Kong, and to ensure enduring success of the "one country, two systems" policy. Only when national security is ensured can "one country, two systems" and Hong Kong's stability and prosperity be guaranteed. This legislation only targets a very narrow category of acts that seriously jeopardize national security and has no impact whatsoever on Hong Kong's high degree of autonomy, the rights and freedoms of Hong Kong residents or the legitimate rights and interests of foreign investors in Hong Kong. It is conducive to the stability and prosperity of Hong Kong, and serves the common interests of the international community. Enactment of the national security legislation for Hong Kong will not bring changes to the "one country, two systems" policy. Rather, the policy will be implemented in a more comprehensive and accurate manner.  

Hong Kong's lasting stability and prosperity pave the way for exchanges and cooperation between Hong Kong SAR of China and all social sectors of Antigua and Barbuda. It is hoped that the law on safeguarding national security in the Hong Kong SAR of the People's Republic of China will be passed and implemented at an early date.
